But it is theft, whether or not you perceive it to be. The law doesn't work as a "I don't want that to be law so it's not".
There are some projects set up to do something along these lines, but they're opt-in;
Plan Zheroes is one that comes to mind. But as Claire said, what are the conditions? How do you decide which charities are good enough to get the donations?
You're right in that there should be incentives for companies to donate waste food, but the potential implications and costs of ensuring those are adhered to are high. The costs of ensuring there are no legal loopholes is in itself expensive. There's not a priority to make it happen at the moment - and who's going to take the lead?
I am in favour of companies doing this, I think it's a great idea, but there are logistical issues affecting it.
