I am currently:
Criminal Record? (section 136)

I was sectioned by the police on Tuesday on a Section 136 (I think?)

and now I'm wondering if this is going to effect my future life in any way
I mean, do I have a criminal record now or something ?

I've always wanted to become a mental health nurse or a police officer
is that now impossible?

I'm scared that this could ruin my life now

(plus I'm still a little shaken up by the section, I still have the bruises from the hand cuffs and restraints, need a hug , anyone ? )

I think it will show up on your CRB for a designated period but just because you have something on your CRB doesnt automatically exclude you from getting the job you want. It will depend on what it is and how many years since you had it. Obviously for either of your chosen career paths, you will need to demostrate a certain level of mental stability any way to pass the occupational health procedure so I would imagine, depending on what happened for you to be 136ed, as long as the occupational health were satisfied, they might be more likely to overlook it.

Try not to worry about this for now, as you've obviously got quite enough of other stuff to deal with right now without worrying about the future. So long as at the time you are thinking of beginning your career training you have demostrated good mental health for an approved amount of time, I dont see it being a barrier to you.

it'll be on records for sure but shouldn't have too much of lasting effect on your future, they might ask you about it ....

i can really relate to being manhandled via section...been there several times and last time was particularly nasty- ended up in a wheelchair for a fortnight!

take care of you and try to take things gently and safely, be kind on you just now.

I am a little reasurred now

In answer to your questions
I tried to OD and cut my wrists on tuesday and somebody called the police and they arrived and tried to stop me from doing it
I understand that they were only doing there job and trying to ensure I was safe but they weren't half brutal in the way they restrained me

They sent me to A+E and I got admitted into a pych ward for a few days, I'm back home now though, hurrah

Yeah the police woman called me attention seeking so I told her to go **** herself, so that might of made her a bit pissed off and rougher,
I don't know, I did apoligise for swearing at her afterwards and she was ok with me, but I was very unco-operative so I guess they had to be rough with me, still, wasn't very pleasant experience.....

Please read the below that I got from legal advice, I was sectioned on a 136 and section 2.

A Standard Disclosure gives details of criminal convictions, cautions, reprimands and warnings held on the Police National Computer. An Enhanced Disclosure may also include relevant information held by local police forces. Therefore, if you were taken to a place of safety under section 136 of the Mental Health Act by the police then this may be disclosed on an Enhanced CRB check. The effect of any Disclosure following an Enhanced CRB check would likely depend on any requirements that the college has and whether the information disclosed would mean that you would be unsuitable to enrol of the course. You should clarify with the college about whether they require an Enhanced CRB check. If an Enhanced CRB check is required and the college does refuse you admission onto the course because of the information that is disclosed you should ask for their reasons to justify doing this.

It was wrong of her to stigmatise you/belittle you like that - even if it was out of a deep need for attention her response was inappropriate.
There is a difference between gently firm and containing with someone, and being rough - look how disruptive children respond to roughness, just by being more out of control, often.
They were clearly not responsive to your vulnerability and fear beneath.
I'll get off my soapbox now, lol

*hugs* i've been under one too.. with the handcuffs and cells etc. I was then put under a 2 and have previously been on a 3.. so guess i never thought much about the 136.. came close though the other night again.. tried to run away to spain, stopped by police.. long story) If you find out what implications it has can you let me know?

  • The Nacro Resettlement Plus Helpline 020 7840 6464 can provide you with information and advice about:
    • Whether an individual may have a criminal record. This is based purely on information you give us – Nacro does not have access to the NPC or any other information.
    • Whether a conviction is spent or unspent.
    • Whether an individual’s record is likely to be eligible to be weeded or not, and how to do this.
    • How you can get a copy of your own criminal record.
    • How you can reassure potential employers about your criminal record.
  • I’ve got a criminal record. Will this stop me from working for positions that require a Disclosure?
  • Ultimately it is for the employer to decide whether somebody is suitable to work in a position. However, having a criminal record should not automatically bar you from a position that requires a Disclosure.

    If your conviction included being added to any of the barring lists (PoCA, PoVA or List 99) or a court imposed ban on working in certain professions, then it may be a criminal act to make an application for employment in those areas.

    All Registered Bodies must have a policy on the recruitment of ex-offenders, which they should make available to you at your request. This is one of the requirements of the CRB’s Code of Practice, which you can view in full by clicking here.

I've had one section 136 and three times where police have come to my house and handcuffed and restrained me.

The sect 136 comes up on an ENHANCED CRB check, not a NORMAL CRB check. I lost my healthare assistant job beause my section 136 came up on my enhanced CRB check.

Section 136s can be very traumatic. Five policemen sitting on you is not nice.



PM me if you want a PDF copy of the ICD-10 or the Mental Health Act 1983/2007. I ALSO HAVE THE DSM-V BOOK and am a pharmacology student.

I have a visual impairment / neurological problems so I need people to type in clear text and no funny fonts. Also excuse any typos, my vision blocks things out.
I have autism and have problems communicating, PMs included.
Just becasue I type well doesn't mean I speak well. I am only part time verbal.
