I don't know about everywhere else but In tasmania (not sure about rest of aus) it's just become illegal to smoke in the car when there are passengers under the age of 18. Which I, personally say thank GOD! Becasue i've had to restrain my self from having a go at people who smoke with all the windows UP with small children in the back. How irresponsible can you get? If you've smoked in your car, it actually lowers the re sell value... smoking in the house, again, lowers the re sell value. I don't mind when people smoke outside but i'm glad the banned it in pubs... I had a massive asthma attack and collapsed in a pub becasue of the smoke... and I didn't know I was asthmatic yet so don't get poopy at me.

Yes it's a free world, and if you're by yourself do what you want. but if you have kids you shouldn't be smoking near them anyway!

A side note: after they introduced the law here they caught over 30 people in ONE day with SMALL children in their car... and only one was over 25.

I really really don't understand all this talk about people smoking in the cars with the windows up. I am a smoker and I would never be able to do that! I also have never seen a smoker do that.

Yeah I dont the talk about the windows up either. I'm a smoker and many of my friends are too, but we would never smoke with the windows up thats just stupid. I never smoke inside or in a car with the windows up. Its my car if I want to smoke in it I should be allowed to, and the whole kids thing, with the windows down barely any smoke gets in the car. As for it being a distraction is you roll your own, yes I can see that being a distraction, but if you are a tailor smoker as long as you dont have to open the packet, eg they are on your dash board or something I dont see it as a distraction, you can still hold the steering wheel with two hands while you are smoking.

I laugh when the government hound smokers - since we know it is bad for us and they are always instituting laws to protect the health of non-smokers, and also encouraging people to quit, you'd think they'd just ban it completely and be done with it. But then there is all that tax they can get from the addicts...

I digress. On the issue of smoking in cars - actually, I do believe it should be banned.

Sorry, but I think that is crap. Since you have to raise the cigarette to your lips to smoke it, you are not always keeping your hands on the wheel while smoking. By that logic, you can answer your cellphone on loudspeaker and hold it in your hand whilst keeping both hands on the wheel. And in this case, you'd be taking your hand off the wheel only to terminate the call. However, holding your phone in your hand whilst driving, even in loudspeaker mode, is illegal. I'm not even getting into lighting the cigarette as being attention-removing from the road as answering the phone. And dropping your phone in the car whilst driving definitely rates as less dangerous than dropping a lit cigarette.

---

I actually used to smoke and I never realised how inconsiderate a lot of smokers are until I quit. Smokers are always moaning about the suspension of their civil liberties - you chose to smoke, I chose not to. You can chose not to light up, but I don't get to chose whether I breathe in your smoke or not if you light up next to me. I don't know why so many smokers find it so surprising that people will exercise their right to tell them to f-off and kindly not smoke over them. There is no law that says I have to be quiet about other people's inconsiderate behaviour nor should I be expected to move because someone decides to light up next to me. Of course, non-smokers should exercise some common sense and not stand by someone who is smoking and moan about it. Likewise, smokers should not assume it is their right to light up wherever they please without asking whoever is around them.

Also, I loathe people who smoke around kids. Even when I smoked two packets a day, I'd never smoke around a kid. Even in my friend's house who has two kids and who smokes in the house herself, I'd still go down the bottom of her garden and smoke - be it rain, shine or Baltic.

So by that reasoning changing gears is also dangerous because you have to take your hand off the wheel, so maybe they should ban all manual cars. Also when you are on the phone you have concertrate on what the other person is saying, when you smoking you don't actually have to pay that much attention to your smoke.

But how often do you have to take your eyes of the road to change gears? I drive an auto btw so that doesn't really mean much to me. But i've seen people lighting up smokes in the car and drifting across lanes becasue they're concentrating on the tip of their cigarette and not the road. I don't think people should smoke around children. ever. i don't care if it's 'your house' or not. If children are around or are going to be around you should smoke outside and on a personal note, as a non smoker it is the worst feeling and smell to walk into a persons house when they've been smoking inside and ive' actually stopped being friends with some people becasue everytime i would go to their house I would feel so sick by the end of the night. I don't care if people smoke, it's their choice. But they should be considerate of others. It's common courtesy not to smoke where your smoke (haha to much smoke) is going to affect others. And when asthma is such a high prevalance these days it's almost a safety issue! The other day in one of our local malls a young girl (i think she was 14) had a massive asthma attack and the ambulance had to be called because she walked past a group of teenagers smoking and inhaled some of it. Now that might be rare to have asthma that sensitive but her inhaler did nothing and she collapsed.

Now i'm going right off the point here lol.

If you smoke it's your choice. if it's only you in the car then do what you want. But it is a distraction. Same as a phone. Some people might not be as distracted but many people are. Sure the government could just ban them but they wont becasue they do get lots of money from them. SO that's not even worth bringing up lol.

So yes. that's my point. And please don't think i'm attacking smokers, and i apologise if i come across like that, i dont' mean to. I don't smoke but i'm friends with plenty of people who do. but they're considerate around me and don't smoke around me unless they're certain it's not going to blow in my face and stuff. So yes. anywho....

I agree that smoker should be considerate of others, hence why I only smoke by myslef or around other smokers. I dont think smoking inside is good at all. And you dont have to take your eyes off the road to light a smoke.

Why not just cut it off at a certain age? Here you can't smoke in a car with a kid under 16 in it. I don't think that banning it from cars all together would be that good of an idea.

GAAAAAARRRRRGGGHHHHH!!!!!!
Can no one make their own choices anymore?
I smoke and i am PERFECTLY AWARE that it is bad for me, i KNOW the consequences- I don't need it drilling into me everytime i move.
I wouldn't smoke with a child in the car or around a child fullstop and anyone who really gave a **** wouldn't either. Banning people from doing things is just going to make them angry. See? Anger!
