Arrested??

"arrested under section 136 of the Mental Health Act 1983"

How is that an arrest?



PM me if you want a PDF copy of the ICD-10 or the Mental Health Act 1983/2007. I ALSO HAVE THE DSM-V BOOK and am a pharmacology student.

I have a visual impairment / neurological problems so I need people to type in clear text and no funny fonts. Also excuse any typos, my vision blocks things out.
I have autism and have problems communicating, PMs included.
Just becasue I type well doesn't mean I speak well. I am only part time verbal.

Is that written in your record? They should have said 'Detained under Section 136 of the MHA 1983', not arrested!!



The freshly qualified Psycho-Pharmacologist who is taking psychiatric medications herself.

I am currently a postgraduate student in Psychiatric Research.

It was written down somewhere in my record, I just remembered it and it gave me a shock. It's on my criminal records too. I agree too Stellata, being unwell is not a crime.

They said that to me when they took me into the custody place and took my details. I was like... I thought I hadn't been arrested, and the (only) nasty policeman said "Well, arrested, detained, same thing... you're here without a choice". I was like... nu-uh.

I am currently:

It's not officially an arrest [as in, technically you're 'detained' under the Mental Health Act, not arrested], but it's classed as an arrest for the powers of PACE etc I believe, so it may be due to that.

Frustrating though. I'm struggling a lot at the moment with the whole s.136/CRB check thing. I understand why it's on there, but it does make things so much more difficult.

i thought that was strange to when i got arrested they treated me like a criminal it just doesnt make sense so there saying u commit a crime cuz your unwell what a load of crap ...........i think its acually called disturbing the peace .....

Nobody ever said I was arrested, it just came up on my records. Thank you all. I think it's f***ing ridiculous too. I now need to work out how to get it off my records.
