Disabiliy discrimination
 
So I got called into work today due to my attendance (47 days off sick in the last year). Most of that is due to my mental health problems, which I declared when I started the job, and a week of it is from when I had surgery and I took the other 3 weeks as annual leave. I was told that I now have my first warning. If I am off sick at all in the next 6 months, I will get a second warning, and anything more than that I could be fired.
I know that if they were to fire me, it would count as disability discrimination, and they are writing to my GP for the third time to ask about my health.
Does anyone know which pieces of legislation are relevant to my situation? I am going to join a union, so at least I would be able to get help from them if this goes further, but until then, I would like some sound facts to defend myself with.

Did you provide them with sick notes when you were off ill? Also did they ever offer you any support when you declared MH issues?

Yeah, they've always had sick notes and I've been through occ health before. They have agreed for me not to go to crowded places as that makes my anxiety terrible, and when I'm not feeling well I don't have to do meds or drive. They did give me the number for a stress helpline, but agreed that since I have quite close contact with my mental health team, and the stressline wouldn't be as good that it probably wouldn't be much use. When the home was owned by the original company, I felt really supported, but we were taken over by a bigger company, who seem really harsh and like they're purely focused on money. I hate the new company and what they've done, but I won't leave until I have to because I care about the service users and don't want their lives impacted by the lack of care that the CARE company shows.
